How can a Multinational Executive or Manager Obtain L-1A Visa?To qualify, a multinational executive or manager must meet several criteria.
First, he or she must show that in the 3 years preceding the application for admission, the noncitizen has worked continuously for at least 1 year for a firm or corporation or other legal entity or an affiliate or subsidiary of the employer that wants to transfer the noncitizen to the United States.
Second, the noncitizen must show that he or she seeks to enter the United States in order to continue to render services to the same employer or to its subsidiary or affiliate in a capacity that is managerial or executive.
The language of the statute limits the application to only those executives and managers who have previously worked for a firm, corporation or other legal entity, or an affiliate or subsidiary of the sponsoring entity, and who are coming to the United States to work for the same entity, or its affiliate or subsidiary in a managerial or executive capacity.
The employer must prove that it meets the requirements of a multinational employer, and has a qualifying relationship with the foreign entity that previously employed the noncitizen. To prove that it is a multinational organization, the company must show that the qualifying entity, or its affiliate, or subsidiary, conducts business in two or more countries, one of which is the United States.
